If a Product becomes unavailable after you've placed an Order, we will notify you as soon as possible, offer a substitute product (if available and acceptable to you), or cancel the Order and issue a full refund. 5. Orders and Payment 5.1. Placing an Order When you place an Order through our Site, you are making an offer to purchase the Products. Your Order is not accepted, and no contract is formed, until we send you an Order confirmation email. We reserve the right to refuse or cancel any Order at our discretion, including where Products are unavailable, there are pricing or description errors, we suspect fraudulent activity, your payment is declined, you have violated these Terms, or we are unable to deliver to your location. 5.2. Order Confirmation Once we receive your Order, we will send you an email acknowledging receipt (this does not constitute acceptance). We will send a separate Order confirmation email once your Order has been accepted and is being processed — this confirms our acceptance and forms a binding contract between you and TheMiniGalerie. 5.3. Payment We accept payment via Credit/Debit Cards (Visa, Mastercard, American Express, etc.), PayPal, and other payment methods as displayed at checkout. Force Majeure We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay is caused by circumstances beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, government action, labor disputes, strikes, lockouts, failure of utility services, telecommunications, or internet services, supplier or courier failures, or fire, explosion, or accidents. In such circumstances, our obligations shall be suspended for the duration of the force majeure event. If the event continues for more than 30 days, either party may terminate the affected Order and receive a refund for any amounts paid. 15. Entire Agreement These Terms, together with our Privacy Policy, Shipping Policy, Cancellation, Exchange, Return & Refund Policy, Warranty Policy, and any other policies referenced herein, constitute the entire agreement between you and TheMiniGalerie regarding your use of our Site and purchase of Products, and supersede all prior or contemporaneous agreements, communications, and proposals between you and us. 22. Survival The following provisions shall survive termination or expiration of these Terms: Intellectual Property (Section 8), Warranties and Disclaimers (Section 9), Limitation of Liability (Section 10), Indemnification (Section 11), Dispute Resolution and Governing Law (Section 12), and any other provisions that by their nature should survive. 23. Amendments and Updates We reserve the right to modify, amend, or update these Terms at any time at our sole discretion, to reflect changes in our business practices or operations, comply with legal or regulatory requirements, or improve clarity or address issues.
